These Terms of Service (“Terms”) govern your access to and use of the Briefcase AI speech therapy practice platform at speech.briefcaseai.io (the “Service”), operated by Briefcase AI (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms.
1. Service Description
Briefcase AI is an AI-powered speech therapy practice tool for children. The Service allows children to practice saying therapy target words, records their attempts, and provides automated pronunciation scoring using artificial intelligence. The Service is designed to supplement — not replace — professional speech-language pathology services.
Important: The Service is NOT a medical device. It is NOT a diagnostic tool. It does NOT provide clinical evaluations, diagnoses, or treatment plans. Automated scores are for practice feedback only and should not be relied upon for clinical decision-making. Always consult a licensed speech-language pathologist (SLP) for professional evaluation and treatment.
2. Eligibility
- You must be at least 18 years of age and the parent or legal guardian of any child whose profile you create on the Service.
- Children under 13 may use the Service only under the supervision and with the consent of their parent or legal guardian.
- By creating an account, you represent and warrant that you are the child’s parent or legal guardian and have the legal authority to consent to the collection of your child’s personal information as described in our Privacy Policy.
3. Account Registration and Security
- You must provide accurate, complete, and current information during registration.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You must notify us immediately at support@briefcasebrain.com if you become aware of any unauthorized use of your account.
- You may not share your account with other individuals. Each parent or guardian must maintain their own account.
4. Parental Consent and COPPA Compliance
The Service collects personal information from children under 13, including the child’s first name, age band, and audio recordings of the child’s voice. In compliance with the Children’s Online Privacy Protection Act (COPPA):
- We require verifiable parental consent before collecting any child’s personal information.
- By verifying your email address and creating a child profile, you provide your consent to our collection and use of your child’s personal information as described in our Privacy Policy.
- You may withdraw your consent at any time by deleting your child’s profile through the Settings page or by contacting us at privacy@briefcasebrain.com.

5. Audio Recording Consent
The core functionality of the Service requires recording audio of your child speaking therapy target words. By using the practice features, you consent to:
- Your child’s voice being recorded during practice sessions
- Recordings being transmitted to our servers over an encrypted connection for automated pronunciation scoring
- Recordings being processed by speech recognition models to generate text transcripts
- Recordings being stored in encrypted cloud storage for the duration of your account (or until you request deletion)
Audio recordings are used solely for pronunciation scoring and practice feedback. They are not used for advertising, marketing, model training, or any purpose unrelated to providing the Service.
6. Subscription and Billing
6.1 Free Trial
New accounts receive a 14-day free trial with full access to all features. No payment information is required to start the trial.
6.2 Paid Plans
After the trial period, continued access requires a paid subscription. We offer monthly and annual plans. Prices are displayed on the pricing page at the time of purchase.
6.3 Payment Processing
All payments are processed by Stripe, Inc. We do not store your credit card or bank information on our servers. By subscribing, you agree to Stripe’s terms of service.
6.4 Auto-Renewal and Cancellation
Subscriptions automatically renew at the end of each billing period. You may cancel at any time through the Settings page. Cancellation takes effect at the end of the current billing period; you will retain access until then. We do not offer partial refunds for unused time.
7. Acceptable Use
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. You agree not to misuse the Service in any way that violates the Acceptable Use Policy.
8. Intellectual Property
- The Service, including its content, scoring logic, themed practice material, user interface, and synthesized audio exemplars, is owned by Briefcase AI and protected by intellectual property laws.
- You may not copy, modify, distribute, sell, or lease any part of the Service or its content.
- You retain ownership of the audio recordings your child creates. We do not claim ownership of user-generated audio.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- Automated pronunciation scores are clinically accurate or equivalent to professional SLP evaluation
- The Service will be uninterrupted, error-free, or free of harmful components
- Use of the Service will result in specific therapeutic outcomes
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIEFCASE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR USE OR INABILITY TO USE THE SERVICE
- ANY RELIANCE ON AUTOMATED SCORING FOR CLINICAL DECISIONS
- ANY UNAUTHORIZED ACCESS TO OR USE OF YOUR ACCOUNT OR DATA
- ANY INTERRUPTION OR CESSATION OF THE SERVICE
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
11. Indemnification
You agree to indemnify and hold harmless Briefcase AI, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or your violation of these Terms.
12. Termination
- By you: You may terminate your account at any time through the Settings page or by contacting support@briefcasebrain.com.
- By us: We may suspend or terminate your account if you violate these Terms, the Acceptable Use Policy, or applicable law. We will provide notice where practicable.
- Effect of termination: Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive relief in any court of competent jurisdiction. You agree to resolve disputes on an individual basis; class actions and class arbitrations are not permitted.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email at the address associated with your account and post the updated Terms on this page at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
